In the current era of Daubert and Kumho Tire, challenges by the opposing side to prevent expert testimony abound.  Experts from Vocational Economics have been the subject of such challenges, as has any expert involved in a significant number of cases.  In every case defended, the challenge has failed and VEI's testimony was accepted by the court.

The links below provide the background of some of these and other related challenges, either by the specific case or by the issue involved.

  • Cases - This page provides links to some recent cases involving challenges to VEI data or methodology to exclude expert testimony.  The cases are of two types: those involving VEI experts and those involving external experts that use The New Worklife Expectancy Tables published by Vocational Econometrics.  Of the defended challenges involving VEI experts, none has been successful.  However, some of the challenges of external experts have (appropriately) succeeded.  They are discussed here to emphasize the importance of the appropriate use of disability statistics. 
  • Issues - Challenges to VEI methodology and data have come in two forms: case-specific challenges to block VEI expert testimony and articles critical of the underlying data.  This page identifies the key issues in the challenges and provides links that provide more detail, rebut the issues, and link to related cases or articles.
